Trust Resolutions: Why Timing and Evidence Matter in 2025

How a Missed Signature Cost a Family Thousands (and What You Can Learn From It)

Running a business in Brisbane is hard enough.

The last thing you need is an unexpected ATO bill. Worse when its because of one missing document or signature.

But that’s exactly what happened in Goldenville Family Trust v Commissioner of Taxation (2025).

Here’s what went wrong… and how to make sure it never happens to you.

“We Thought We’d Done Everything Right”

The Goldenville Family Trust earned a healthy income over 2015-2017.

They decided to distribute most of it to a family member overseas, so it’d be taxed at just 10%.

Smart move? Not Quite.

The ATO reviewed and decided those trust resolutions weren’t valid.

The issue wasn’t about who got the income, but when the decisions were actually made.

Some documents were dated 30th June, but no one could prove the decisions were made before 30 June.

The ATO felt the paperwork could have been created months later, after the accountant finished the books.

As a result, the default beneficiaries (Australian residents) were taxed at much higher tax rates.

Tens of thousands lost, because of poor timing.

Why This Matters to You

If you have a family trust, this could happen to you too.

The paperwork isn’t the only thing that’s important. It’s fine if you type up the formal document later.

The key is to prove that a real decision was made before year-end.

Simple example

✅ Say the trustees meet on 29 June, discuss, and decide who gets what.

Those decisions are valid, even if you type up the minutes up a few days later.

❌ But say you waited till July to make a decision, then dated it June 30.

That’s when the ATO steps in.

And suddenly:

  • The wrong people get taxed
  • You get a massive unexpected bill
  • You lose trust in your whole setup

You can backdate paperwork. You can’t backdate a decision.

The Real Cost

It’s not just paperwork and taxes.

It’s about control over your income, your assets, and your family’s wealth.

When decisions are made late (or undocumented), the ATO gets the final say on where your money goes.

That’s the opposite of what a trust is meant to do.

You built your business to create freedom.

Don’t lose it over a missing email or unsigned minute.

How to Protect Yourself

This timing problem isn’t just about trusts.

It also hits company loans, dividends, and director drawings.

Each can result in thousands to tens of thousands in extra taxes.

That’s why we tell all our Brisbane business clients to:

  1. Know your deadline. Most trust resolutions must be done by 30 June.

  2. Make real decisions early. Even a short meeting counts as long as it happens before the deadline.
  3. Create evidence. A quick, time-stamped email to your accountant confirming the decision is enough.
  4. Check your paperwork, and make sure it matches what really happened.

That’s it. Simple steps that can save you from a costly ATO dispute.
